Welcome to Devil’s Half Acre. These Terms and Conditions (“Terms”) govern your access to and use of devilshalf.com and www.devilshalf.com (the “Site”) and, where applicable, your interactions with Devil’s Half Acre (“Devil’s Half Acre,” “we,” “us,” or “our”).

By accessing or using the Site, you agree to these Terms.

Additional rules or policies communicated at our physical premises may apply to guests visiting Devil’s Half Acre.

1. About Devil’s Half Acre

Devil’s Half Acre operates a seasonal beer garden in Blue Hill, Maine.

Our establishment may offer:

  • Availability;

3. Seasonal Operations and Hours

Devil’s Half Acre operates seasonally.

4. Alcoholic Beverages

Devil’s Half Acre serves alcoholic beverages.

Alcoholic beverages may be purchased, possessed, and consumed only in accordance with applicable federal, Maine, and local laws.

We reserve the right to:

  • Request valid government-issued identification;

  • Refuse alcohol service where identification is insufficient;

  • Refuse service to a person who appears intoxicated;

  • Limit alcohol service;

  • Discontinue service;

  • Remove or refuse entry to a guest engaging in unsafe or disruptive conduct; and

  • Take other reasonable measures necessary to comply with applicable alcohol laws and protect guest safety.

Guests must not provide alcoholic beverages to minors or otherwise violate applicable alcohol laws.

5. Responsible Consumption

Guests who consume alcoholic beverages are responsible for doing so responsibly.

Do not drive or operate a vehicle while impaired.

Devil’s Half Acre does not assume responsibility for a guest’s decision to drive or otherwise engage in unsafe conduct after consuming alcohol, except to the extent responsibility cannot legally be limited.

6. Children and Minors

Devil’s Half Acre welcomes families and children.

Children must remain appropriately supervised by a parent, guardian, or responsible adult at all times.

Parents and guardians are responsible for the safety and conduct of children accompanying them.

Certain areas, activities, events, or circumstances may require additional restrictions for safety or legal reasons.

7. Dogs and Other Animals

Well-behaved dogs may be permitted in designated areas of the property.

Dogs must remain on a leash and under the control of their owner or handler.

Owners are responsible for:

  • Supervising their animals;

  • Cleaning up after them;

  • Preventing disruptive behavior;

  • Preventing damage to property; and

  • Preventing injury to guests, employees, or other animals.

We may require an animal to be removed if it is aggressive, disruptive, uncontrolled, or creates a safety or sanitation concern.

Service animals are handled in accordance with applicable law.

8. Outside Food

Devil’s Half Acre offers food and snacks but may permit guests to bring outside picnic-style food into designated outdoor areas.

Outside food must be consumed only in areas where it is permitted.

We may restrict outside food from indoor areas, food-service areas, special events, or other locations for health, safety, operational, or licensing reasons.

Guests are responsible for appropriately storing and handling food they bring onto the premises.

Devil’s Half Acre does not prepare, inspect, or control outside food and is not responsible for its quality, ingredients, allergens, handling, or safety.

9. Food Allergies and Dietary Requirements

Menu items may contain or come into contact with common allergens.

Guests with food allergies, sensitivities, or dietary restrictions should communicate their needs before ordering.

Although reasonable efforts may be made to accommodate requests, we cannot guarantee that any food or preparation area is completely free from a particular allergen unless expressly stated.

Guests bringing their own food remain responsible for determining whether that food is appropriate for their dietary needs.

10. Reservations and Larger Groups

Devil’s Half Acre generally does not operate through standard reservations.

Guests planning to visit with a group of approximately eight or more people are encouraged to contact us in advance so that we can evaluate available space and accommodations.

Contacting us does not create a guaranteed reservation unless we expressly confirm one.

Group accommodation is subject to:

  • Capacity;

  • Staffing;

  • Events;

  • Weather;

  • Scheduling;

  • Available seating; and

  • Other operational considerations.

11. Events and Live Music

Devil’s Half Acre may host live music, performances, special events, community gatherings, or other activities.

Event schedules, performers, times, admission conditions, and availability may change or be cancelled.

A scheduled event may be altered or cancelled because of:

  • Weather;

  • Performer availability;

  • Illness;

  • Technical problems;

  • Safety concerns;

  • Governmental restrictions; or

  • Other circumstances outside our reasonable control.

Unless otherwise stated, publication of an event does not guarantee that it will occur exactly as originally advertised.

12. Outdoor Areas

Our establishment includes outdoor spaces.

Outdoor premises naturally involve conditions that may include:

  • Uneven ground;

  • Grass;

  • Gravel;

  • Wet or slippery surfaces;

  • Weather exposure;

  • Insects;

  • Vegetation;

  • Steps;

  • Outdoor furniture; and

  • Other ordinary outdoor conditions.

Guests should exercise reasonable care and supervise children appropriately.

13. Weather

Because Devil’s Half Acre includes outdoor gathering space, weather can materially affect operations.

Rain, thunderstorms, lightning, excessive heat, high winds, severe weather, or other conditions may result in:

  • Event cancellation;

  • Delayed opening;

  • Early closure;

  • Seating restrictions; or

  • Other operational changes.

Guest safety takes priority over maintaining published schedules.

14. Guest Conduct

Guests must behave in a lawful and respectful manner.

You may not:

  • Engage in threatening, violent, or abusive conduct;

  • Harass employees, performers, or other guests;

  • Damage property;

  • Interfere with employees or business operations;

  • Engage in unlawful activity;

  • Provide alcohol to minors;

  • Bring prohibited substances onto the premises;

  • Create unreasonable safety risks; or

  • Refuse reasonable instructions given for safety or compliance purposes.

We reserve the right to refuse service or require a person to leave when reasonably necessary to protect guests, employees, property, or business operations, subject to applicable law.

15. Personal Property

Guests are responsible for their personal belongings.

To the extent permitted by law, Devil’s Half Acre is not responsible for personal property that is lost, stolen, forgotten, damaged, or left unattended on the premises.

16. Parking and Vehicles

Guests are responsible for safely and lawfully parking and operating their vehicles.

Parking availability is not guaranteed.

To the extent permitted by law, Devil’s Half Acre is not responsible for theft, damage, or loss involving vehicles or their contents except where caused by conduct for which liability cannot legally be excluded.

17. Photography and Events

Photography or video recording may occur during public events.

Guests may also take photographs for ordinary personal use provided they do not interfere with business operations, performers, employees, or other guests.

Commercial photography, organized photo shoots, or substantial recording activity may require advance permission.

We will obtain appropriate authorization where required before using identifiable individuals for commercial promotional purposes.

18. Prices and Menu Availability

Food, beverage, and other prices may change without advance notice.

Menu items and beverages are subject to availability.

The appearance of a product or menu item on the Site does not guarantee that it will be available during a particular visit.

19. Intellectual Property

Unless otherwise indicated, the Site and its original content, including its text, graphics, design, photographs, logos, layout, and other proprietary materials, are owned by or licensed to Devil’s Half Acre and are protected by applicable intellectual-property laws.

You may use the Site for personal, non-commercial purposes.

You may not reproduce, distribute, commercially exploit, or systematically copy proprietary Site content without permission except where permitted by law.

20. Third-Party Content and Websites

The Site may include:

  • Embedded video;

  • Social-media links;

  • Maps;

  • Event information;

  • Third-party websites; or

  • Other externally operated services.

We do not control those third parties and are not responsible for their content, security, availability, policies, or practices.

Use of third-party services is subject to their own terms and policies.

22. Disclaimer of Warranties

WE DISCLAIM IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT TO THE EXTENT PERMITTED BY LAW.

WE DO NOT WARRANT THAT WEBSITE INFORMATION, INCLUDING HOURS, EVENT SCHEDULES, MENU ITEMS, OR PRODUCT AVAILABILITY, WILL ALWAYS BE COMPLETE OR CURRENT.

23. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, DEVIL’S HALF ACRE AND ITS OWNERS, EMPLOYEES, AGENTS, AND CONTRACTORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATING TO USE OF THE SITE.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited under applicable law.

24. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless Devil’s Half Acre and its owners, employees, agents, and contractors from third-party claims, liabilities, damages, and reasonable expenses resulting from:

  • Your unlawful conduct;

  • Your violation of these Terms;

  • Damage caused by an animal under your control;

  • Your violation of another person’s rights; or

  • Your misuse of the Site or premises.

25. Force Majeure

Devil’s Half Acre is not responsible for delays, cancellations, closures, or inability to perform caused by events reasonably outside our control, including:

  • Severe weather;

  • Storms;

  • Power outages;

  • Governmental restrictions;

  • Public emergencies;

  • Equipment failures;

  • Supply disruptions;

  • Performer cancellations; or

  • Similar circumstances.

26. Governing Law

These Terms are governed by the laws of the State of Maine, without regard to conflict-of-law principles.

Subject to applicable law, disputes concerning the Site or these Terms will be brought in a court of competent jurisdiction in Maine.

27. Severability

If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will remain effective to the fullest extent permitted by law.

28. Changes to These Terms

We may update these Terms periodically.

The revised version will be posted on the Site with a new “Last Updated” date.

Continued use of the Site after revised Terms become effective constitutes acceptance to the extent permitted by applicable law.
